The following terms and conditions apply to the sale of all products by Gotham Sound and Communication, Inc., hereinafter referred to as Gotham. The terms and conditions stated shall apply to all sales transactions. Purchaser accepts these terms and conditions by placing an order online, over the phone, or in person at our store. No exceptions to these terms will be binding unless agreed upon in writing by an authorized representative of Gotham. Gotham reserves the right to amend these terms and conditions at any time. Current terms and conditions supersede all previous agreements between purchaser and Gotham.
All prices are in US dollar amounts. All online and store prices reflect current prices and are subject to change without any prior notice. Gotham is not liable for any typos in quotes or sales orders. Gotham charges sales tax on all orders shipped or picked-up in New York State, unless a tax exemption is submitted before the sale is processed. For any sales tax questions, please contact [email protected]. All products not in stock may be drop shipped based on availability from the manufacturer. Orders are not binding until accepted by Gotham. All shipping estimates may be adjusted during the ordering process.
Payment for all orders are due prior to shipping unless Gotham has approved the account for NET terms (please see credit terms below). If credit card address does not match the shipping address, Gotham reserves the right to ask for additional authentication. Purchases may be considered COD depending on type or size of order. Gotham accepts all major credit cards, PayPal and wire transfers. Special orders will not be shipped from manufacturer until payment is received in full. Drop shipments are subject to tax based on destination. Orders containing back orders may be partially shipped at purchaser's request.
NET terms may be granted to companies in good credit standing. Please allow at least two weeks for NET terms to be processed. Please contact [email protected] to inquire about a NET terms account. NET purchasers will be invoiced upon shipment of order.
Gotham can process international sales for a variety of products. Please contact a Gotham representative for details. Gotham does accept wire transfers, although they may be subject to an additional wire transfer fee. Please contact [email protected] for details.
All orders are shipped with insurance and signature required unless we receive authorization in writing, approving changes to this policy. Gotham will select the carrier of shipping unless specifically instructed in writing by the purchaser. Purchaser assumes cost of all shipping unless other terms have been prearranged. All shipment arrival dates are estimates. Gotham is not liable for any shipment not received by delivery estimated date. Purchaser assumes full liability for all items damaged or lost in transit if insurance is waived. If insured, payment for lost or damaged products fall on the shipping carrier.
Delivery to a delivery service, courier or messenger constitutes delivery to a purchaser. Full liability of sale transfers to purchaser upon pick-up or delivery to delivery service.
N.B.: Shipping time is calculated independently of processing time and all orders must be approved before shipping. Our typical response time is a few hours during normal business hours (9AM-6PM, M-F); however, please allow up to one business day. If you need it in a hurry, please call us at 212-629-9430.
Purchaser must immediately inspect and fully check items and quantity of all sales upon delivery. Be careful not to damage any manufacturer's packaging. Do not discard any packing materials including boxes, bags, instructions, or manuals until you are sure you want to keep the item. Gotham cannot accept sale items for return if any warranty paperwork has been filled out, items are damaged, or items are missing. It is the responsibility of the purchaser to report any missing or damaged gear within 1 business day of receipt of the equipment. Please read all instruction manuals before using any equipment bought from Gotham.
Please read all warranty information before using sales items. Most items sold by Gotham are covered by the manufactured warranty. When a purchased item is still under a manufacturer's warranty and/or warranty period has passed, please directly contact the manufacturer or an authorized service center. Gotham urges you to fill out all warranty information cards provided with applicable items. Any other question please contact [email protected].
Orders are not eligible for return except where allowed by the return policy of the individual manufacturer. If you would prefer to try an item before you purchase it, please contact us to arrange a free demo. Purchaser must contact Gotham within 3 days of receipt of sales item to be eligible for any refund. Please call or e-mail [email protected] for a return authorization number prior to returning items. All items must be in original packaging and contain all parts to be returned. Refunds may take up to 30 days to process once the items are received.
Walkie accessories and expendable items are not accepted for return. Expendables include batteries, media, tape, hush lavs, foam, wireless accessories, canned air, mic flags, headphones, sound reports, surveillance, anything with earpieces, alcohol swabs, caboodle cases, NeoPax, stickies (over or under), moleskin, top stick, mic bras, and battery chargers.
If a custom-made item has been properly assembled to a customer's specifications, it cannot be returned; however, in some cases, in may be possible to rewire it. Additional fees may apply. Contact [email protected] for specifics.
Unless defective, any item may be subject to a 20% restocking fee or returned to customer with no refund granted. Condition of all returns is subject to authorized Gotham staff member.
Cancellation of orders prior to shipment from Gotham that have been approved with PO, written confirmation, verbal confirmation, or credit card are subject to cancellation fees that might include: shipping costs to Gotham, restocking fees, or full value of item on special orders.
It is the purchaser's responsibility to complete all rebate forms and return them to the manufacturer within the stated time frame. Please read all rebate forms before discarding any packaging material.
